Raj Kundra’s lawyer comments on his arrest for pornography case; ‘Vulgar content but cannot be classified as porn’

Businessman Raj Kundra was arrested by the Mumbai Crime Branch on Monday night for allegedly making pornographic movies and publishing them through his mobile apps. After learning about his arrest his lawyer defended him by objectifying to classify the vulgar content as porn. On Tuesday Raj Kundra's lawyer, Abad Ponda had made an argument in the court.

Raj Kundra's lawyer had reportedly said that it was not right to apply section 67A of the Information Technology in electronic form with sections in the Indian Penal Code (IPC) that is dealing with pornography as per the Laws 'Actual Intercourse' is considered as 'porn' and anything other than this is just 'Vulgar Content'. Further adding to his words lawyer Ponda has said that the police has been following what web shows are working these days 'Vulgar Content' and however it is not classified as a pornographic film. The Lawyer further added by saying that arrest should be only made when the investigation cannot go ahead without it.

He said, "Police custody should be an exception and not a norm. Arrest should be made only when the investigation cannot move further without the arrest. In this case, the accused was made to join the investigation once he was arrested." The lawyer defended the arrest by saying that it wasn't made as per the law.
